{"id":19615,"date":"2026-10-28T08:30:00","date_gmt":"2026-10-28T13:30:00","guid":{"rendered":"https:\/\/www.mundovideo.com.co\/en\/?post_type=opinion&#038;p=19615"},"modified":"2026-10-28T06:56:11","modified_gmt":"2026-10-28T11:56:11","slug":"brazil-regulated-betting-then-shut-the-market-down","status":"publish","type":"opinion","link":"https:\/\/www.mundovideo.com.co\/en\/opinion\/brazil-regulated-betting-then-shut-the-market-down\/","title":{"rendered":"Brazil regulated betting \u2014 then shut the market down"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Brazil has just turned its betting market into a case study in regulatory risk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fixed-odds sports betting was legalized under <strong>Law 13.756 of 2018<\/strong>. Five years later, <strong>Law 14.790 of 2023<\/strong> completed the framework for sports betting and online gaming. Brazil then created the Secretariat of Prizes and Betting \u2014 SPA \u2014, the SIGAP system, mandatory .bet.br domains, compliance requirements, anti-money-laundering controls, responsible-gaming rules and <strong>SPA\/MF Ordinance 827 of 2024<\/strong>, which structured the authorization regime.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><a href=\"https:\/\/www.mundovideo.com.co\/landing\/multigame-link\/\" target=\"_blank\" rel=\" noopener\"><img loading=\"lazy\" decoding=\"async\" width=\"700\" height=\"700\" src=\"https:\/\/www.mundovideo.com.co\/en\/wp-content\/uploads\/sites\/2\/2026\/10\/image-153.jpeg\" alt=\"\" class=\"wp-image-19618\" style=\"width:840px;height:auto\" srcset=\"https:\/\/www.mundovideo.com.co\/en\/wp-content\/uploads\/sites\/2\/2026\/10\/image-153.jpeg 700w, https:\/\/www.mundovideo.com.co\/en\/wp-content\/uploads\/sites\/2\/2026\/10\/image-153-150x150.jpeg 150w, https:\/\/www.mundovideo.com.co\/en\/wp-content\/uploads\/sites\/2\/2026\/10\/image-153-300x300.jpeg 300w\" sizes=\"auto, (max-width: 700px) 100vw, 700px\" \/><\/a><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">From January 2025 onward, only licensed operators could legally offer betting nationwide.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Market entry was not inexpensive. Each authorization cost <strong>R$30 million<\/strong>, covered up to three brands and was granted for five years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then came <strong>Provisional Measure 1.394, dated September 25, 2026<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its Article 1 prohibited the exploitation, offering, intermediation and advertising of fixed-odds betting throughout Brazil, including both sports betting and online gaming. Article 4 ordered the termination of existing authorizations within 30 days and added a particularly significant provision: operators would have <strong>no right to reimbursement of licensing fees or compensation from the State<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Decree 13.128\/2026<\/strong> subsequently created an interagency committee to coordinate enforcement of the prohibition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By October 6, licensed websites had stopped accepting bets. At that point, approximately <strong>R$1.325 billion<\/strong> still had to be returned to around <strong>26.5 million bettors<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is where the regulatory paradox becomes difficult to ignore.<\/p>\n\n\n\n<p class=\"line-height1 has-large-font-size wp-block-paragraph\"><em>\u201cOnly fifteen days before banning the market, the SPA had issued<\/em> <strong><em>Ordinance 2.750\/2026<\/em><\/strong><em>, strengthening mechanisms designed to identify and block payments to illegal betting operators. Brazil had spent years building tools to distinguish authorized companies from offshore and unlicensed operators\u201d.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Weeks later, it eliminated the authorized side of the market.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Illegal demand, of course, did not disappear.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By October 9, the government had identified <strong>20,318 websites and digital channels<\/strong> associated with unlawful betting activity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Provisional Measure 1.394 must still pass through Congress. It enters urgency status on <strong>November 9<\/strong>, while its current deliberation period runs through <strong>November 23<\/strong>.
