Colombia changing restrictions of anti-laundering money laws

Coljuegos published the draft resolution with which they seek to modify Resolution 20195100044514 by which the requirements for the implementation of the system for the prevention and control of money laundering and financing of terrorism were established.

 

In which it modifies the PEPs, publicly exposed persons, distributing them among different groups, as follows:

 

National PEPs: Public servants of any system of nomenclature and classification of jobs of the national and territorial public administration, during the period in which they occupy their positions and during the two (2) years following their resignation, resignation, dismissal or declaration of dismissal of the appointment, or any other form of disengagement.

 

Foreign PEPs: Are those natural persons who exercise public functions of senior management in another country. Especially the following: (i) heads of state, heads of government, ministers, undersecretaries or secretaries of state; (ii) congressmen or parliamentarians; (iii) members of supreme courts, constitutional courts or other high judicial instances whose decisions do not normally admit of appeal, except in exceptional circumstances; (iv) members of courts or of the boards of directors of central banks; (v) ambassadors; (vi) chargés d'affaires; (vii) senior officers of the armed forces; (viii) members of the administrative, management or supervisory bodies of state-owned enterprises; (ix) members of reigning royal families; (x) prominent leaders of political parties or movements; and (xi) legal representatives, directors, deputy directors, senior management and board members of an international organization (vr. heads of state, politicians, senior governmental, judicial or military officials and senior executives of state-owned companies).

 

It is important to note that in no case do these categories include middle or lower level officials. Additionally, they will be considered foreign PEPs, during the period in which they occupy their positions and during the two (2) years following their resignation, resignation, dismissal or any other form of disengagement.

 

PEPs of International Organizations: Those natural persons who perform managerial functions in an international organization, such as directors, deputy directors, members of boards of directors or any person who performs an equivalent function, during the period in which they hold their positions and during the two (2) years following their resignation, resignation, dismissal, or any other form of disengagement.

PSD Party Senator Expresses Frustration with the Delays in Implementing the Law Regulating Sports Betting in Brazil.

Senator Angelo Coronel, from the PSD party in Bahia, seems frustrated with the delays in implementing the law regulating sports betting in Brazil. He criticizes the Ministry of Finance for its sluggishness in collecting the grants for operating licenses, despite the estimated significant revenue of at least R$5 billion that could benefit the public coffers.

The senator views this potential revenue as a means to address other fiscal issues, such as compensating for payroll tax exemptions for certain sectors and small municipalities, which have faced legal challenges.

Although the law regulating the betting market was passed at the end of 2023, the appointment of the head of the Secretariat for Prizes and Betting, the Treasury body responsible for overseeing betting operators, only occurred recently. Senator Coronel expresses his frustration with this delay, emphasizing that Congress acted promptly in approving the legislation, but the government has been slow to implement it.

The taxation structure outlined in the law includes a 12% levy on bookmakers’ revenue and a 15% tax on punters’ winnings. These measures were part of Finance Minister Fernando Haddad’s plan to help achieve a zero fiscal deficit by 2024.

The Secretariat for Prizes and Betting is currently focused on drafting regulations governing the operation of the betting market in Brazil. Once these regulations are in place, interested legal entities will undergo evaluation, including criteria related to integrity and prevention of fraud. Over 130 companies have expressed interest in operating in the Brazilian market.

 

 

It’s highlighted that the law provides legal entities operating in Brazil with a minimum of six months to comply with the regulatory provisions once they are established. Senator Coronel hopes that the newly appointed Secretary for Prizes and Betting, Regis Dudena, will expedite the regulatory process.

Representatives of the Secretariat of Prizes and Betting (SPA) of Brazil met with authorities of the Buenos Aires Lottery (LOTBA), taking advantage of their visit to Buenos Aires during the CIBELAE 2024 Conference.

 

 

 

 

Simone Vicentini [pictured] , deputy secretary of the SPA, had a meeting with Jesús Acevedo, president of LOTBA, and his team, a meeting in which executives from Gaming Laboratories International (GLI), a certification company approved in both jurisdictions, also participated.

 


The participation of SPA members in the Cibelae 2024 Conference revolved around this year's central theme: "Sports Betting in Latin America: approaches to a developing market." The SPA, created in February of this year to regulate sports betting and online casino games, plans to develop and implement a regulatory framework for online gaming, payment methods, strategies for responsible gaming and prevention of money laundering.

 

All these areas are of reference for the LOTBA, and the meeting also served to share that experience.
