Coljuegos, presented this week its financial report that shows a good evolution in the performance of gambling industry in the reactivation process during the first month of the year.

Face-to-face gambling generated P28 trillion (almost USD7,129m) in total gross sales last year, while online gambling contributed P16 trillion (USD4,073m).

 

The trend of growth and recovery from the pandemic is registered in the year-on-year comparison, while in January 2021, gross sales were $1,596,065m COP (USD400m), in January 2022 that number rose to $2,719,141m  COP (USD692m).

 

The same goes for online gambling, in January 2021 gross sales were $932.633m COP (USD237m), while in January 2022 they were $1,702.081m COP (USD433m).

 

Regarding the plans for 2022, according to what was reported by the local media La Patria, Coljuegos intends to "increase the number of METs by 3 percent and evaluate the proposals for complementary mechanics presented by the concessionaire of the novel game: Lotto". The main objective is the generation and development of more resources for health.

 

The authority assured that it plans to approve new gambling licenses to expand the offer, issuing the permits up to 10 working days after the new modalities are presented.

 

The second great objective of Coljuegos for this year will be to work even more for the promotion of responsible and legal gambling, which includes audits in face-to-face and online gambling halls. In this sense, reports will be created where "the main data of the operations of all the new games to be implemented in the betting houses will be included in a clear way, thus promoting the transparency of the sector".

 

On the other hand, it also foresees to reach new Covenants for Legality throughout the country, the blocking and closing of unauthorized operators and "to fulfill 100 percent of the Accounts of the Anticorruption and Citizen Attention Plan, as well as to implement a Risk Management System in all the existing operators of games of chance in the territory.

 

The last general objective will be "strengthening the management of Coljuegos". To achieve it, the following activities are planned: to execute an investment project dedicated to the digital transformation of Coljuegos and to carry out an analysis to improve all those aspects related to the security of the information systems.

 

In addition, they plan to execute the following plans: Annual Audit Plan, Anti-Corruption and Citizen Service Plan (PAAC), Information Security and Privacy Plan, Communications Plan and Information Security and Privacy Risk Treatment Plan.

 

They also intend to improve the satisfaction indexes of the internal users of the Coljuegos platform through a series of surveys and to identify all those processes of distribution of the resources of the new games that are implemented in the betting house, as well as to implement a payment solution for them. In this sense, manuals will be developed for the users, including a step-by-step description of the activities and each internal process of the betting houses.

The Secretariat of Prizes and Betting (SPA) - an entity of the Brazilian Ministry of Finance - recently issued Ordinance SPA/MF 722/2024, which details the technical and security requirements that sports betting and online gaming operators must meet. The technical requirements focus on the technological infrastructure of the betting systems. Specifically, all authorized operators must store the betting system and the corresponding data in data centers located in Brazil.

In exceptional circumstances, systems and data may be located outside Brazil, but must meet certain criteria. Operators must present to the SPA an explanation of why their systems are kept outside Brazil. The data center must also be ISO 27001 certified.

 

 

These conditions include that the countries have an International Legal Cooperation Agreement with Brazil in civil and criminal matters. Data owners abroad must authorize data transfers in advance. To facilitate effective supervision, operators must provide the SPA with data on bets, players, customer portfolios, legal destinations, and other operational information. This manual will soon be available on the website of the Secretariat, which may request additional information from the operator at any time.

 

On the other hand, operators must obtain certification of their platforms and systems from entities recognized by the Ministry of Finance. They must meet strict technology and security standards to protect consumers against potential fraud or unauthorized access.

Senator Angelo Coronel, from the PSD party in Bahia, seems frustrated with the delays in implementing the law regulating sports betting in Brazil. The senator views this potential revenue as a means to address other fiscal issues, such as compensating for payroll tax exemptions for certain sectors and small municipalities, which have faced legal challenges.

Although the law regulating the betting market was passed at the end of 2023, the appointment of the head of the Secretariat for Prizes and Betting, the Treasury body responsible for overseeing betting operators, only occurred recently. The taxation structure outlined in the law includes a 12% levy on bookmakers’ revenue and a 15% tax on punters’ winnings. These measures were part of Finance Minister Fernando Haddad’s plan to help achieve a zero fiscal deficit by 2024.

The Secretariat for Prizes and Betting is currently focused on drafting regulations governing the operation of the betting market in Brazil. Once these regulations are in place, interested legal entities will undergo evaluation, including criteria related to integrity and prevention of fraud. Over 130 companies have expressed interest in operating in the Brazilian market.

 

 

It’s highlighted that the law provides legal entities operating in Brazil with a minimum of six months to comply with the regulatory provisions once they are established. Senator Coronel hopes that the newly appointed Secretary for Prizes and Betting, Regis Dudena, will expedite the regulatory process.
