Ecuador’s top court approves casino referendum question, rejects two others from President Noboa

Quito, October 5, 2025 — Ecuador’s Constitutional Court has approved one of President Daniel Noboa’s proposed questions for a national referendum — the one seeking to legalize casinos in five-star hotels — while rejecting two other initiatives on procedural and constitutional grounds. The ruling gives the green light for Ecuadorians to decide whether the country should allow the reopening of regulated casinos under strict parameters. The measure marks the first major attempt to revive the gaming industry since its nationwide ban in 2011, following a referendum pushed by former president Rafael Correa.

According to the Court, the accepted question meets all legal and constitutional standards for a clear, single-subject query. However, two additional questions proposed by Noboa were struck down. Judges determined that they contained “compound elements,” combining unrelated fiscal, social, and regulatory topics that could confuse voters and violate the principle of unity of matter.

The Court’s decision represents a partial win for President Noboa, who has sought to use popular consultations as a means of advancing reforms in areas ranging from security and employment to economic reactivation. Legal experts note that allowing casinos in luxury hotels could stimulate tourism and attract foreign investment, but will also reignite debates over gambling’s social impact.

Political analysts see the outcome as another example of the delicate balance between the Executive and the Court. The judiciary has repeatedly emphasized that referendum questions must be narrowly focused and avoid political packaging of complex issues.

With this ruling, the government must now draft final language and prepare for an official announcement of the next referendum, likely to take place in early 2026. If voters approve, Ecuador could see the return of a regulated casino industry — a controversial yet potentially lucrative revival for its hospitality and tourism sectors.
