Curaçao tightens online gambling: new LOK rules raise control and transparency in 2026

Curaçao is accelerating the transformation of its gaming industry through stricter enforcement of the LOK (Landsverordening op de kansspelen) framework, in force since December 24, 2024, fundamentally reshaping its online gambling model. The reform is driven by the Ministry of Finance, led by Javier Silvania, and executed by the Curaçao Gaming Authority (CGA), now responsible for licensing, supervision, and enforcement across both digital and land-based gaming.

The structural shift is clear: Curaçao is moving away from its legacy sub-licensing model toward a system of direct licensing, data control, and continuous regulatory oversight. Under LOK, operators must establish local entities, report critical operational data, obtain approval for corporate changes, and comply with stricter KYC, AML, and player protection standards.

The latest regulatory focus targets terms and conditions (T&Cs), now treated as enforceable compliance tools. The CGA requires them to be clear, accessible, and aligned with actual operations, covering accounts, funds, withdrawals, jurisdiction, dispute resolution, and responsible gaming. This shift reduces ambiguity and limits abusive practices, strengthening transparency across the market.

The framework also introduces key technical obligations. Operators must use certified infrastructure, host critical data in high-security servers located in Curaçao, provide regulatory access to player and transaction data, and report incidents within 24 hours. Meanwhile, the “local substance” requirement under Article 5.12 has been postponed until April 1, 2027, allowing a phased transition.

Institutionally, the system integrates multiple actors. The CGA leads regulation, while the Central Bank of Curaçao and Sint Maarten (CBCS) and the Financial Intelligence Unit (FIU) oversee financial integrity and AML compliance. The Ministry of Justice, led by Shalten Hato, plays a role in key regulatory decisions, including transitional measures.

Strategically, Curaçao is shifting from a low-friction licensing hub to a compliance-driven, internationally credible jurisdiction, prioritizing transparency, financial traceability, and enforceability. With the 2027 local substance deadline approaching, the market is moving toward higher operational standards, where only structured operators with strong compliance capabilities will remain competitive.
