The Colombian Attorney General's Office does not take its eye off Coljuegos

The Attorney General's Office informed this Tuesday in a statement that after the contracting process for the operation of the Baloto was declared void for the third time, the Public Ministry urged the president of Coljuegos, César Augusto Valencia Galiano, to guarantee the obtaining of the revenues that will be destined to the health system.

 

"In view of the existence of risks in public management, it is a priority to apply the principles of planning, transparency and free concurrence of state contracting", said the control entity in the letter, and at the same time requested Coljuegos to "inform the decisions and actions that will be taken to grant the Baloto in concession, or if it will administer or operate the game directly".

 

The Attorney General's Office also reiterated that in this case there are no unforeseeable or irresistible facts, or circumstances that justify adopting an exceptional, temporary and extreme measure to resort to a contractor selection procedure that does not guarantee the plurality of bidders and reminded that any direct contracting must obey the law of guarantees.

 

In addition, taking into account that this is the third process that is declared deserted, the Public Prosecutor's Office referred the matter to the Superintendence of Industry and Commerce to evaluate the occurrence of possible conducts contrary to free competition.

 

"It should be noted that, with this action, the Attorney General's Office seeks to anticipate and avoid situations that affect the resources for the health of Colombians, and that the exercise of the preventive function does not imply in any way the co-administration or interference in the administrative, financial, technical or legal decisions of state entities or individuals who exercise public functions," warned the disciplinary control entity
