Promotional games are all those whose activity offers a prize to the public, without the player having to make any kind of payment to participate in this.
These modalities include sweepstakes, bingo, sports betting, winning products, instant lottery (such as scraping and winning), lotto pre-printed and among others.
With this, Coljuegos seeks to expand the tools that companies can seek to achieve customer loyalty, increase sales, reach new customers and promote their brand.in fact, Coljuegos with this, seeks to allow companies to work under a legal framework for the sake of their growth, which creates a subaltern consequence of the improvement of coffers that are directed to the health of Colombians. However, in order to understand how to use this type of tools, it must first be known that the exploitation rights will be paid on the total value of the prize plan and each prize contained in the plan must not exceed one hundred sixty (160) Minimum Monthly Wages Laws in force. As second point to emphasize it is important to understand the classification of these promotional games which are governed between two categories, by authorization and excepted.
By Authorization:
This is the mode in which the games are organized and operated for the purpose of advertising or promotion of goods or services, establishments, companies or entities, in which a prize is offered to the public, without access to the game to be paid directly.
The operating rights of this promotional game classification are equivalent to fourteen percent (14%) of the total value of the prize plan and for administrative expenses corresponding to 1% of the value of the exploitation rights.
These rights mentioned must be canceled by the natural or legal person managing the game at the time of authorization of the same, and all prizes advertised must be held by the public.
Excepted:
- Luck games of a traditional character, family and school.
- Promotional games made by operators of games of luck and chance.
- Raffles for financing the fire department.
- Promotional games of departmental charities and capitalization societies.
Any natural or juridical person who intends to carry out promotional games of chance that he or she considers are in the exceptions provided for in the Law or in the current regulations, shall request and obtain Coljuegos or the respective departmental public capital company (SCDP), the Concept by which that circumstance is established, for which it must accredit the requirements established in said provision. In addition to understanding the type of qualification that each game has, it is important to know who are the entities that regulate them according to their affectation to society, first Coljuegos regulates national games (two or more departments or municipalities of different departments or A department and the capital district), the Departmental Public Capital Society regulates them if the activity is of departmental and municipal level, whereas the Lottery of Bogota under Decree 148 of 2003, authorizes and issues the required concepts in the Capital District
Now, Coljuegos as regulator of the industry of games of luck and chance in Colombia issued some tips for the correct development and under a legal framework of promotional games.
1. Submit the complete documentation: Form No.6, Citizenship Card of the legal representative, invoice or quote with certificate that guarantees the resources for the same plan of awards and finally the guarantee of compliance.
2. Submit the request in writing with an anticipation of not less than 15 working days at the start of the promotional game.
3. Advertising of the game of chance and promotional chance before obtaining the authorization cannot be initiated.
4. None of these promotional activities should exceed the year.
5. Only financial institutions and insurers are authorized to deliver cash prizes.
