Until today December 21 of 2017, Coljuegos will be receiving the respective comments and observations regarding the draft administrative act which modifies the procedure for the authorization of localized games.
"In the general aspects of this project, the operation of games located through third parties is highlighted, which may be done by legal entities that obtain authorization through an administrative act ... subscribe the concession contract with Coljuegos and comply with the execution requirements in accordance with the indicated in Laws 80 of 1993, 643 of 2001, 1150 of 2007, Decrees 1068.1082 of 2015 and 1580 of 2017, and other norms that add, modify or complement them.
These requests for authorization desired by the legal entities that intend to operate in the gambling industry in the form of located (slots) should be made through the web platform enabled by Coljuegos, called the Operator Portal. For these applications, a little more than 16 legal requirements must be fulfilled, as well as other financial requirements:
Among the financial requirements is the liquidity where applicants for concession contracts must demonstrate a liquidity index equal to or greater than 1.2. The liquidity index (LIQ) will be obtained with the application of one of the following formulas:
1. First formula Liquidity capacity = Ebitda / Current Liabilities> 1.2
Where the Ebitda is calculated in the following way:
Ebitda = Operating Profit + Depreciation + Amortizations
2. Liquidity (LIQ) = Current Assets / Current Liabilities ≥ 1.2
Finally, among the 30 different articles of the administrative project that seeks to modify Resolution 724 of 2013, Coljuegos may reject the applications in progress in the following cases:
1.- Due to default.
2.- Due to inability to operate games of luck and chance.
3.- For undue completeness of the requirement made.
4.- Failure to comply with the financial indicators provided in Article 10 of this Resolution.
However, there will be no prejudice for the application to be presented again with the fulfillment of the legal requirements.
Article 32 of Law 643 of 2001 defines localized games as the modality of games of chance that operate with equipment or elements of games, in commercial establishments, which players attend as a necessary condition to be able to bet, such like the bingos, videobingos, spherodromes, slot machines, and those operated in casinos and similar.
In the same way, for Coljuegos it is necessary to update and adjust the regulations that establish the relationship between localized game operators and the regulating entity, in order to incorporate new policies and procedures aimed at rationalizing and simplifying existing procedures, thus achieving timely, efficient and effective way, grant the concession authorizations of the games of luck and chance in the modality of located.
