Coljuegos. From December 14 to 16 Coljuegos will be receiving comments from all the operators on the draft resolution that emphasizes the payment facilities in the contracts for the concession in gambling industry, which will adapt the internal regulation of collection of portfolio (Resolution 20165300002424 of February 8, 2016).
This project presents all the limits, opportunities and requirements that will have the facilities of payment offered by Coljuegos to the entrepreneurs.
Here are the 8 conditions that must be met to obtain the payment facilities:
1. Through a reasoned administrative act, up to a maximum of three (03) monthly quotas of operating rights and administrative expenses shall be granted. Your request must be submitted with the necessary documentation in the framework of the administrative procedure indicated in article 86 of Law 1474 of 2011.
2. The payment term may not exceed the period of nine (09) months and in no case, may exceed the term of execution of the contract.
3. The single guarantee of compliance with the concession contract must be in force.
4. The application must contain the list of the delinquent installments, the offer of the initial installment, which may not be less than twenty percent (20%) of the amount owed and the term requested for the payment facility.
5. No facilities shall be granted to operators who have used them within the last twelve (12) months.
6. All ease of payment will contain an acceleration clause that indicates the causes of unilateral termination and the pertinent consequences. Once the facility for non-compliance has been terminated, the procedure set forth in article 86 of Law 1474 of 2011 will be resumed to declare non-compliance, expiration, effectiveness of the penal clause or application of fines as applicable.
7. In the event of failure to comply with two (02) successive quotas of the agreement, its non-compliance shall be declared and the term granted shall be deemed to be terminated.
8. No payment agreements will be entered with debtors that are reported in the debtor's delinquent bulletin due to non-compliance with payment agreements, unless the default is remedied and the National Accounts Administrator issues the corresponding certification."
