Rhode Island is poised to become the first U.S. state to classify underage online gambling as a criminal offense, as House Bill 7935 moves forward following a reversal vote by the Judiciary Committee.
The bill, sponsored by Rep. Gregory Costantino, would make it a misdemeanor for anyone under 21 to participate in online casino gambling, punishable by up to one year in jail or a $500 fine. This aligns digital gambling penalties with those currently imposed for underage alcohol and tobacco use in the state.
The initial committee rejection on April 23 raised concerns over the criminalization of minors. However, the bill was reconsidered after additional support and clarification, passing with bipartisan backing. It now heads to the full House for a vote.
Rhode Island legalized online casino gaming in March 2024, joining six other states with regulated iGaming platforms. While the legal gambling age is 21, digital access remains difficult to enforce, especially among tech-savvy youth.
Critics argue that the bill could disproportionately punish young users rather than focus on prevention. By contrast, states like New Jersey, Michigan, and Pennsylvania prioritize education, parental controls, and industry self-regulation over punitive measures for underage users.
Supporters contend that legal clarity and enforcement tools are essential to safeguarding the integrity of the state’s gaming market and protecting vulnerable populations. If enacted, Rhode Island’s law could set a national precedent, sparking similar legislation in states with emerging online gambling industries.
