Lima, October 22, 2026. Peru's Ministry of Foreign Trade and Tourism (MINCETUR) has proposed reducing maximum fines for online casino and sports betting operators by 65%, from 200 to 70 Tax Units (UIT), equivalent to a reduction from PEN 1.1 million to PEN 385,000. The reform also introduces changes to advertising obligations, technological controls, and regulatory enforcement mechanisms.

The initiative, promoted by Minister Rogers Martín Valencia Espinoza, was formalized through Ministerial Resolution No. 382-2026-MINCETUR, dated October 20 and published on October 21 in the official gazette El Peruano. It amends the regulations approved under Supreme Decree No. 005-2023-MINCETUR, implementing Law No. 31557, as amended by Law No. 31806.

The proposal reduces maximum fines for minor violations from 50 to 11 UIT (PEN 60,500) and for serious violations from 150 to 35 UIT (PEN 192,500). Very serious violations could still result in license cancellations and disqualifications lasting up to ten years or permanently.
Fines would generally be capped at 10% of annual gross revenue, except for repeat offenders and illegal operators. Admitting liability would allow discounts of 50%, 35%, or 25%, depending on the stage of administrative proceedings.

The General Directorate of Casino Games and Slot Machines, headed by Yuri Guerra Padilla, would oversee the changes. Its structure includes licensing and enforcement departments associated with Ruth Giovanna Llerena Villa and Vanessa Gisselle Cabrera Rivas, respectively. Regarding advertising, influencers would be required to identify commercial promotions, avoid targeting minors, and display problem gambling warnings for five seconds in videos or across 10% of static advertising materials. INDECOPI would oversee advertising violations.

The reform would also reduce minimum password lengths from eight to four characters, extend reauthentication intervals from 30 days to six months, and reduce the frequency of automated software checks from every 24 hours to every 30 days. MINCETUR reports 4,559 authorized betting venues and had blocked 86 illegal platforms by October. The public consultation will remain open until November 5, 2026, with the proposed amendments not yet in force.
