The National Health Superintendency, by means of external circular 000006 of March 31, 2020, addressed to the supervised, and applicable after January 1, the following measures that have a direct effect on the industry of gambling.
For entities supervised by the Superintendency of Health that must comply with the report of the following type files, the shipment is deferred until 5 business days after the ordinary assembly meeting has been held, in accordance with article 5 of decree 434 of 2020, which establishes that ordinary assembly meetings may be held until within the month following the end of the declared health emergency in the national territory.
Files type:
1. FP 001- Complete Set of Financial Statements and Disclosures.
2. FP002- Certification of financial statements.
3. FP003- Tax review opinion.
4. FP004- Management report.
5. FP005- Profit distribution projects.
6. FT002- Financial Statements Publications.
An important note here is that for the verification of compliance, a copy of the assembly minutes must be sent as an additional document in the technical annex FP001.
On the other hand, the lottery operators also suspended the sending of the technical annexes that are listed in the circular, due to the temporary suspension of the ordinary and extraordinary draws established in agreement 51 of 2020 issued by the National Council of Gambling.
Finally, in the tenth and eleventh instruction, the health superintendence is allowed to clarify that the technical annexes that are not mentioned in the external circular 004 of 2020, nor in the instructions described in this circular with number 000006 of 2020, must be reported in the dates established according to the circulars previously issued, likewise, that the dates stipulated in the circulation that are shared here may be modified if the National Government extends the health emergency.
It also takes into account the methods of spread and contagion and empowers not to take biometric information that compromises the user.
