It is normal that casinos around the globe use marketing strategies to reach clients attentions such as giving tickets, money, cars, trips away so clients come more often or expends more than normal.
In New York, the River Casino & Resort, hosted a promotional drawing last year, rewarding the winner with a new Jaguar or a $25,000 cash prize..
Normally these drawings have clear terms and conditions so in case of having any problem everything had been said in advance.
The drawing entries was via their Rush Rewards Player club card, and Deanna Dipofi visited the casino and had earned entries. At the moment when the winner was chosen, she wasn’t present or onsite during the drawing, so the prize was given to another player.
Reason that lead Deanna to suit the casino because they did not stipulate that the winning player had to be onsite during the drawing, with no condition set on claiming the prize as the lasts drawings they made.
Alan Ripka & Associates, lawyers of Dipofi are also arguing that other drawings had conditions on promotional materials that stated the prize would be reduced if the winner was not on site to claim it during the drawing, but for this one didn’t exist those conditions.
Until now the casino hasn’t pronounced yet due to the pending litigation over the matter.
